BACKGROUND
Megan Hemmings T/a Self Sown Healing is an Australian Practitioner of holistic and somatic healing modalities who offers a range of individual and group services online or in-person.

PARTIES
This Terms of Service or Agreement is made by and between Megan Hemmings ABN 61 794 667 113 T/a Self Sown Healing (also referred to as the 'Practitioner', 'Facilitator', 'us', 'our', 'we', 'they') and YOU, the Client (also referred to as 'participant', 'student', 'your') and is legally binding.
​​​​​​​​​​​​The purpose of this Agreement is to clarify the roles and expectations of working together. This Agreement supersedes and prevails over any prior agreement or understanding (if any) between you and the Practitioner.

By receiving this Agreement via email or through our website www.selfsownhealing.com and by continuing to use the services provided by us, you are considered to have read and accepted this Terms of Service, even if you haven't signed it.​​

Please read our Terms of Service carefully. You can review the most current version at any time at www.selfsownhealing.com/terms-of-service (a link is also provided in the website footer). We reserve the right to update, change or replace any part of this Terms of Service by posting updates and/or changes to our website.
It is your responsibility to check this page on the website periodically for changes. Your continued use of or access to the website and our services following the posting of any changes constitutes acceptance of those changes.​​

SERVICES
We provide individual and group services to Clients.

Full descriptions for each service including fees are available on the website.

Service title and price are also clearly stated on your invoice / receipt during the payment process.
Additional services
-
We may include additional services, or the inclusions may change to suit Client needs and preferences.

This Agreement applies to any agreed additional services.
-
Additional services will be confirmed with the Client / Participant in writing via the email address provided confirming your original service time/s and delivery.
Current services
-
Complimentary Call: up to 30 minute individual meeting online or by phone (national call within Australia).
-
A complimentary and confidential call with the practitioner for a range of individual purposes.
-

Self Sown Healing: 1 hour weekly individual sessions for 3 weeks (3 sessions) s via Zoom.
-
Personalised sessions grounded in Embodied Processing as well as other somatic and holistic approaches to help build your inner resources and with option to work with personal topics that present for healing.

​Ancestral Groundwork: individual session - up to 90 minutes via Zoom.
-
Family ancestral map exploration and Systemic / Family Constellations experientials to help you find your place in the family field and gain fresh insights about self and life from a systemic and holistic perspective.
-
This session is a prerequisite before your first Immersive Constellation.

Immersive Constellation: individual session - up to 90 minutes via Zoom.
-
A one-on-one Systemic and Family Constellation to help uncover, shift and heal ancestral generational patterns underlying your issue or topic.
-
Prerequisite - one Ancestral Groundwork session.

Slow Mindful Yoga: open or private small group programs - 1 hour weekly in-person classes held by the term (variable length)
-
Classes offering personalised and integrated breathing, movement, relaxation and meditation practices which are usually suitable for adults of all ages.

SERVICE DELIVERY
You understand and agree:
-
Individual services are delivered via Zoom online video conferencing.
-
An individual service which is complimentary or part of a group service may also be delivered via phone call (Australian numbers only) at the Practitioner's sole discretion.
-
Group services are delivered in-person at a private or public venue (depending on the service).
-
Services are required to be booked through the website at www.selfsownhealing.com.
-
Services must be booked and completed within the agreed timeframe.
-
Services booked may not include or be attended by a third party (yours) unless agreed in advance by both you and Practitioner.
-
Services are non-transferrable.
-
Services are not delivered to Clients / Participants based in the US or under its governance.
-
Any changes to times for a service or delivery must be requested in writing to the email address provided confirming your original service time/s and delivery.​
​Rescheduling & Cancellations
-
Rescheduling and cancellations for any service is permitted via the email address provided confirming your original service time/s and delivery.
You understand and agree:
-
To cancel and reschedule a session for an individual service, including a Complimentary Call, you must give at least 24 hours notice.
-
To reschedule an individual service which is a single session, it must be held within 3 months of the original booking.
-
If the individual service involves multiple weekly sessions, rescheduling is to fit within the original timeframe specified but may be extended depending on the circumstance and at the sole discretion of the practitioner.
-
To cancel a group service without penalty, you must give at least 7 days notice prior to commencement.
-
Classes for a group service offered by the program or term are missed at your own discretion with no guarantee of make up classes within the term or rolling over missed classes to the next term.

​If you cancel and/or reschedule any service with insufficient notice or are a no-show, it may result in forfeiture of that service with any additional services considered a new booking and charged accordingly.​

The practitioner reserves the right to cancel and/or reschedule any service at their sole discretion (see refunds below).​

​PAYMENT
You understand and agree:

Full payment of the fee is required to secure and book the paid service selected.
-
Pricing is valid for the term of the service provided.
-
We are not under any obligation to maintain the same offer or pricing should you wish to extend the service term.
-
All prices are stated in Australian Dollars.
-
All payments are required to be made using PayPal (credit card or funds transfer).
REFUND POLICY

You understand and agree:
-
To receive a full refund before commencing your service, you must give at least 24 hours notice of cancellation for an individual service and at least 7 days notice for a group service.
-
Your refund request after cancellation with the required notice must be within 180 days of original payment.
-
Refund requests for services you cancel with inadequate notice or after a no-show due to exceptional circumstances are considered on an individual basis and are given at the Practitioner's discretion.

If the Practitioner cancels an individual or group service you will receive a refund.
-
If the Practitioner reschedules a group service you can opt to receive a refund or have fees held in credit.
-
All requests for refunds must be made in writing via the email address provided confirming your original service time/s and delivery, detailing the reason for your request.

CLIENT / PARTICIPANT OBLIGATIONS
​Individual and group services
​You understand and agree:

You are of legal adult age.
-
Working with us requires your willingness to engage in open communication and respectful conduct.
-
Our services can involve somatic or body-centred and intense emotional experiences as well as light to moderate physical activity and you accept full responsibility for your participation and processing.
-
It is your responsibility to disclose any recent, existing or new health issues or conditions - physical, psychological or psychiatric - as well as any specific needs before commencing an individual or group service and on an ongoing basis and you will arrange a call with the Practitioner as needed to discuss confidentially.​

Depending on your individual situation, there may be times when a service is not recommended or you may need to provide a letter from your GP or other medical specialist letter stating you can participate in a service.
- ​You will also not participate in any service if suffering psychosis, using mind-altering drugs, other hallucinogens, recreational drugs or are on medication that may trigger strong emotional or physical responses.

If during services you experience significant discomfort, difficulties or challenges you will ensure this is promptly communicated to the Practitioner so you can be appropriately supported.
​Additional obligations for group services​​
You understand and agree:

​You acknowledge that any discussions, conversations and, in particular, any identification of any individual is to be kept private and confidential outside group sessions for a service.

Any comments, feedback, information, recommendations, experiences or other discussions you may participate in (Comments) during any group session for a service is to be made in the spirit, culture, context and ethos of the group session and purpose generally and promote a respectful, safe and secure environment.

Comments are not permitted that encourage illegal intent, fraud and collusion, defamation, harassment or solicit business, are abusive or malicious against any other participant, the Practitioner or any third party.

We may remove and ban you or any other participant who violates these Terms, without notice and at our sole discretion.
-
We may take any other action, where required, against any person that does not abide by these Terms or where action is taken against us by any person, visitor or third party as a result of your Comments.
-
Opinions, advice and all other information expressed by participants in Comments are theirs and not that of the Practitioner or anyone associated with the group or business. You rely on and/or act on any such information at your own risk.

Any action you choose to take with any other participant or person in any group, outside the group or indirectly through our services, including but not limited to the provision of your personal information, phone, email, arranging a meeting, setting up social media groups or other activities with anyone is at your own risk. We are at no time responsible for or liable for any action you choose to take under any circumstance.
Session or class preparation

You will prepare for each session of a service based on information provided.

You will be ready on time for each session
-
You will arrive 5-10 minutes early for group classes and workshops.
-
Where your individual session is online, you will ensure you are somewhere private and undisturbed so you can be completely present.
Communication
-
All questions and queries are to be directed to us via the email address provided confirming your original service time/s and delivery.

Communication is managed as above.

INTELLECTUAL PROPERTY

We own all Intellectual Property and related material (the "Intellectual Property"), including but not limited to articles, reports, resources, audio, literature, written documents, questionnaires, videos, specifications or another other material that may be:
-
required to assist and enable the Services to be performed;
-
developed or produced under this Agreement or through the course of or arising out of working with you.

The Client is granted a non-exclusive limited-use license (personal only) of this Intellectual Property.
-
The title, copyright, intellectual property rights and distribution rights of the Intellectual Property remain exclusively with the Practitioner.
ACKNOWLEDGMENT & DISCLAIMER

The Practitioner holds professional qualifications, certifications, membership and coverage and works in accordance with generally accepted industry practice and standards. However, they are not a doctor, psychologist, psychiatrist, lawyer or financial advisor. It is important to consult with medical, legal and financial professionals for specific assistance in those areas.
You understand and agree:

Services with us may result in both tangible and intangible changes. This may involve experiences, including but not limited to, an energy release, a shift in mood or emotional state, an increased sense of internal well-being and a shift in how you view your world.

We bring to your experience our personal and professional expertise, offering a unique and valuable presence.
-
At all times, you are responsible for your decisions. Your well-being is the primary focus, and we are here to support you on your journey with the utmost respect and care.

You have engaged our services at the agreed Fee, acknowledging the value of the support, guidance and facilitation provided.
-
While we strive to offer valuable services, the outcomes of these services cannot be guaranteed.
-
You acknowledge that the effectiveness of the services and the information, support, guidance and facilitation provided depends on many factors, including your commitment. As such, you are 100% responsible for your participation in these services as well as any individual outcomes.
-
The Practitioner and Self Sown Healing or anyone associated with the delivery of our services are not liable for any damages, loss, or injury arising from your reliance on any information, support, guidance or facilitation provided. This is only for the purposes of your well-being and empowerment and you must use your judgment and make your own decisions.

If you have any specific questions or concerns about any medical matter, you will consult your doctor or healthcare provider promptly.
-
If you believe you may be experiencing a medical condition, you will seek immediate medical attention from your healthcare provider.
-
You will not delay seeking medical advice, disregard medical advice, or discontinue medical treatment because of information, support, guidance or facilitation received from us.
-
Nothing in this disclaimer limits or excludes any liability that cannot be limited or excluded by applicable law.

By engaging in these services, you acknowledge and agree to the above terms, understanding that we are here to support you, but you are ultimately responsible for your well-being and decisions.
CONFIDENTIALITY

In working together, the relationship must be built on trust; thus, the Practitioner is committed to the utmost confidentiality.
-
All information (written or verbal) that you share with us, and vice-versa, as part of the relationship will be kept confidential, unless disclosure is required in circumstances such as:
-
group services where you are engaging in collaborative processes and shared experiences (such as a class or workshop)
- practitioner supervision for professional development (your name and contact details remain anonymous)
-
fear for your or another person's safety (as required by law)
-
a court order or subpoena (as required by law)
-

We will keep details of all consultations, sessions, client information, and associated data shared for purposes required to complete the contracted services confidential during and after the period of this agreement.

While every effort will be made to maintain the security and confidentiality of all information shared, we take no responsibility for the security of information shared via third-party applications such as email providers or social media platforms that may be accessible to third parties.
-
We will not use your full name in a testimonial or acknowledgement given without first receiving your written consent.
-
We will not photograph or record any services you participate in without first receiving your written consent.
-
Photos or recordings will not be made public in any way unless a written agreement is sought from you.​

LIABILITY AND INDEMNITY

Our liability for services is governed by Australian Consumer Law and these Terms and Conditions.

Your statutory rights as a consumer under Australian Consumer Law are fully protected.
-
We exclude all other express or implied guarantees, warranties, and terms except those stated here to the extent permitted by law.
-
We guarantee that our services will be provided with due care and skill and will meet the advertised purpose.
-
If we can't exclude liability, our total liability is limited to re-supplying the services or refunding what you paid at our discretion.
Warranty and Indemnification

We will provide our services diligently, with proper care and skill, and according to the terms of this Agreement.

You agree to protect us from any claims related to:

The performance or non-performance of our services, or
-
Any breach of this Agreement.

TERMINATION
-
Either Party may terminate this Agreement by providing at least 48 hours notice in writing to the other Party.
Termination by us
-
Except as provided in this Agreement, where this Agreement is terminated with or without cause and through no action or fault of the Client, any payment for unfulfilled services without any fees or charges will be refunded to the Client.

Payment for fulfilled services will not be refunded.
Termination by you
-
Except as provided in this Agreement, where the Client terminates this Agreement, the Client is liable for all outstanding fees. Payment is required in full within 3 working days of the termination date.

Payment for fulfilled services will not be refunded.
CONCERNS AND ISSUES
You understand and agree:

You will contact us immediately with any concerns to be resolved quickly and effectively through friendly consultation.

In the unlikely event a dispute cannot be resolved in the first instance, the following Dispute Resolution Procedure must be followed:

You must advise us in writing of the nature of the dispute, the outcome you seek and what actions you believe will settle the dispute.
-
You agree to meet in person or online in good faith to resolve the dispute by agreement and compromise.
-

If an agreement cannot be reached to resolve the dispute, any party may refer to a mediator to determine the time and place for mediation.
-
Both parties must attend the mediation in good faith to resolve the dispute through mediation or other alternative dispute resolution processes.
-
The parties agree that legal action will only be commenced if mediation is unsuccessful.
-
Confidentiality is paramount to the reputation of both Parties.
-
At no time will any communications or discussions be made public. This includes but is not limited to any social media platforms or websites of either Party.
-
Any public discussion or comments about either Party will be considered defamatory, harmful or otherwise damaging and will be the subject of compensation in any mediation or litigation claim.
GOVERNING LAW

The State of NSW Australia governs the Terms and Conditions of this Agreement.
-
Both parties agree to unconditionally submit to the non-exclusive jurisdiction of the Courts of New South Wales for determining any dispute concerning this Agreement.​​​
